1. About DrivingPro
DrivingPro is an online marketplace platform connecting learner drivers ("Students") with licensed driving instructors ("Instructors") in Australia (the "Platform"). We facilitate bookings, payments, and communication between Students and Instructors, but we do not provide driving instruction ourselves.
Students use DrivingPro to find, book, and pay Instructors for driving lessons. Eligibility and account requirements for Students are set out in Section 2.
Instructors use DrivingPro to list their driving lessons, manage bookings, and receive payments. Instructors are independent contractors and not employees or agents of DrivingPro. Eligibility and account requirements for Instructors are set out in Section 3.
By creating an account or using DrivingPro, you agree to these Terms.
2. Student Accounts
To use DrivingPro as a Student, you must:
- Be at least 16 years of age and hold a valid learner permit (or equivalent provisional licence where applicable) issued by the relevant Australian state or territory authority
- Provide accurate and complete information when registering
- Keep your login credentials secure and confidential
- Carry your learner permit during all lessons
- Not share or transfer your account to another person
If you are under 18 years old, you represent and warrant that your parent or legal guardian has read, understood, and consented to these Terms on your behalf, and that they accept full responsibility for your use of the Platform.
3. Instructors on DrivingPro
Instructors are independent contractors who offer driving lessons through DrivingPro. They are not employees, agents, or representatives of DrivingPro, and DrivingPro is not a party to the lesson arrangement between you and your Instructor.
To list lessons on DrivingPro, an Instructor must hold a valid driving instructor accreditation for their state or territory, which we verify during onboarding before they can list lessons — see Section 7 for how we verify this and the standards we hold Instructors to throughout their time on the Platform. If you have any doubt about an Instructor's accreditation, you may ask to see it directly.
4. Bookings & Cancellations
When you book a lesson, you enter into a direct arrangement with the Instructor. DrivingPro facilitates this process but is not a party to the agreement between you and the Instructor.
Cancellation terms are set by individual Instructors and, where provided, are displayed on their profile before you confirm a booking. Where no cancellation policy is stated, contact the Instructor directly to confirm their terms before booking.
Where an Instructor cancels a confirmed booking, DrivingPro holds payment for any lesson not yet delivered and will refund it to your original payment method. For lessons already delivered, contact the Instructor directly in the first instance, or DrivingPro if the matter is unresolved.
5. Payments & Service Fee
Students may pay either offline or online. Online payments are processed securely through Stripe. The following provisions apply to online payments processed through Stripe. If you choose to pay offline, please confirm payment terms directly with your Instructor before booking.
A service fee of between 2.5% and 4.5% may apply, depending on the payment method and any applicable international card surcharges. This fee covers payment processing costs, and is disclosed at checkout before you pay. It is non-refundable where a booking is cancelled by a Student, as the related costs have already been incurred.
DrivingPro holds your online lesson payment until each lesson is delivered, and pays the Instructor after delivery. Payment for lessons you have not yet taken remains refundable to you. Refunds are returned to your original payment method, less third-party payment processing fees where applicable.
To limit your exposure on any single purchase, DrivingPro sets a maximum permitted price for lesson packages; Instructors cannot list a package above this amount, and the cap is displayed at checkout. We may vary this maximum from time to time. We also encourage you to book a trial session before purchasing a larger package — see Section 6.
6. Trial Sessions
Every Instructor on DrivingPro must offer at least one trial session as part of their lesson listing — this is a Platform requirement enforced when an Instructor creates or updates their lessons, not merely a recommendation. We strongly encourage you to book a trial session before committing to a larger package, so you can assess an Instructor's teaching style, communication, and vehicle before making a bigger purchase.
7. Quality Assurance & Instructor Standards
We take the following steps to support a safe and professional standard of service on DrivingPro. These measures are intended to reduce risk for Students; they do not guarantee the quality, safety, or outcome of any lesson, and each Instructor remains solely responsible for their own conduct as an independent contractor.
- Credential verification — Instructors must submit accreditation documents during onboarding (see Section 3). We verify submitted accreditation documents through third-party verification services and/or manual review before allowing an Instructor to list lessons. Verification is limited to the documents submitted to us during onboarding. We do not independently monitor, audit, or continuously verify an Instructor's ongoing accreditation, licensing, insurance, suitability, or legal compliance after onboarding. Accreditation status remains subject to renewal, suspension, or revocation by the relevant issuing authority, which is outside our control.
- Mandatory trial session — every lesson listing must include a trial session so you can assess an Instructor before a larger commitment (see Section 6).
- Maximum package pricing — DrivingPro caps the price an Instructor may charge for a lesson package (see Section 5).
- Complaint handling and enforcement — you can report safety or conduct concerns through the process described in Section 9. Where we substantiate a complaint, we may, at our discretion, issue a formal warning, suspend, or terminate an Instructor's access to the Platform. We may take this action based on a single serious incident or a pattern of substantiated complaints, and may do so without prior notice to the Instructor where we reasonably consider it necessary to protect Students.
- DrivingPro does not verify, monitor, or guarantee the existence, adequacy, validity, or ongoing status of any public liability insurance, comprehensive vehicle insurance, or other insurance held by Instructors.
We administer these measures at our reasonable discretion based on the information available to us at the time. We do not warrant that every Instructor meets these standards at all times, and we encourage you to report any concerns promptly so we can investigate and take appropriate action.
8. Reviews
After completing a lesson, you may leave a review and rating to share your experience on the Platform. Reviews must be honest, accurate, and based on your genuine experience. We may remove reviews that are fraudulent, abusive, or that breach Section 10 (Code of Conduct).
We may remove, edit, refuse, or moderate any review, rating, profile content, or communication at our sole discretion.
You grant DrivingPro a non-exclusive, worldwide, perpetual, irrevocable, royalty-free licence to host, display, reproduce, and use content submitted to the Platform for the purpose of operating, improving, and promoting the service. You retain ownership of content you submit.
Users are solely responsible for content they submit.
9. Dispute Resolution & Complaints
DrivingPro is a marketplace platform that connects Students with independent Instructors. We do not act as an arbitrator or mediator between Students and Instructors, and we are not a party to the lesson agreement between you and your Instructor.
If you experience an issue with a booking or lesson:
- First, attempt to resolve it directly with your Instructor.
- If unresolved, or if your concern involves safety, harassment, discrimination, or other unprofessional conduct, file a complaint through your dashboard once the lesson is marked complete. Select the category that best describes the issue — for example, no-show, unsafe driving, inappropriate behaviour, harassment, or other unprofessional conduct — and provide supporting details.
- We review reported complaints and may take action under Section 7, including issuing a warning, suspending, or terminating the Instructor's account where a complaint is substantiated.
- For payment disputes, you may initiate a dispute through Stripe's standard process.
- For consumer protection matters, you may contact your state or territory fair trading authority, or the ACCC at https://www.accc.gov.au.
We aim to review complaints promptly, but DrivingPro does not guarantee a specific outcome, time frame, or remedy from any complaint or dispute process.
10. Code of Conduct
All users must:
- Treat others with respect and courtesy
- Not engage in harassment, discrimination, or unsafe behaviour
- Not share false or misleading information, including about qualifications
- Provide honest reviews and ratings
Instructors are expected to conduct lessons safely and professionally at all times, including maintaining a roadworthy vehicle and any insurance and licensing required by law. DrivingPro does not verify or guarantee the existence, adequacy, validity, or ongoing status of any insurance held by an Instructor. Violations of this Code of Conduct may result in account suspension or termination, and for Instructors, may be assessed under the standards in Section 7.
11. Limitation of Liability
Nothing in these Terms excludes, restricts, or modifies any consumer guarantee, right, or remedy conferred by the Australian Consumer Law or any other law that cannot be excluded, restricted, or modified by agreement.
DrivingPro provides the booking and payment Platform and is not the provider of driving instruction. We do not guarantee the conduct, quality, or outcomes of lessons delivered by independent Instructors. The Platform software is provided without warranty beyond what is required by law.
To help protect Students, DrivingPro:
- verifies Instructor accreditation documents before listing (Section 3),
- caps the maximum price of lesson packages (Section 5),
- requires every Instructor to offer a trial session (Section 6),
- operates a complaint process and may suspend or terminate Instructors in response to substantiated complaints (Sections 7 and 9).
DrivingPro does not guarantee uninterrupted availability of the Platform. We are not responsible for delays, interruptions, failures, or inability to access the Platform caused by circumstances beyond our reasonable control, including failures of telecommunications networks, cloud service providers, payment processors, third-party software providers, natural disasters, government actions, or other force majeure events.
To the maximum extent permitted by law, DrivingPro's total liability arising out of or relating to the platform shall not exceed the total service fees paid to DrivingPro by the affected user during the 12 months preceding the claim.
12. Indemnity
You agree to indemnify and hold harmless DrivingPro, its directors, officers, employees, and contractors from claims, losses, damages, liabilities, and expenses arising from your breach of these Terms, your use of the Platform, or content submitted by you.
13. Termination
We may suspend, restrict, or terminate access to the Platform at our reasonable discretion where necessary to: (a) investigate suspected fraud; (b) protect the safety or security of users; (c) comply with legal or regulatory obligations; (d) prevent misuse of the Platform; or (e) enforce these Terms.
If you close your account, pre-paid lessons that have not been completed remain subject to the Instructor's cancellation policy. If DrivingPro suspends or terminates an Instructor, we will endeavour to notify affected Students with upcoming bookings. DrivingPro holds payment for undelivered lessons and can refund them to you directly. To request a refund for lessons you have not taken, contact DrivingPro or your Instructor. Nothing in this clause limits your rights under the Australian Consumer Law.
We may remove or disable access to content associated with a terminated account.
14. Assignment
You may not assign or transfer your rights or obligations under these Terms without our prior written consent. We may assign or transfer our rights and obligations under these Terms as part of a merger, acquisition, corporate restructure, or sale of assets.
15. Instructor Payouts, Reserve & Refunds
The following applies to payments for lessons booked and paid through DrivingPro:
- Earnings for a lesson are released after the Student confirms it, or automatically after the confirmation window.
- Released earnings are paid out on the Platform's payout schedule (twice monthly).
- A fixed reserve of $2,000 is held as security while you teach on the Platform. It accumulates from your earliest released earnings until the full amount is reached, and no further amount is held after that. The held amount is always visible on your earnings page, and is fully returned after you stop teaching on the Platform, following a final safety period after your last delivered lesson.
- Funds for undelivered sessions belong to the Student and are refundable to them at any time while under the Platform's control; refunds are reversed from your pending balance.
- The Platform fee is earned at purchase and is non-refundable.
- Complaints do not affect payment; they inform account standing.
16. Student Refunds & Lesson Confirmation
The following applies to payments for lessons booked and paid through DrivingPro:
- After each lesson, you can confirm completion; unconfirmed lessons are automatically confirmed after a short window.
- Refunds cover undelivered sessions only and can be claimed at any time while the funds are under the Platform's control. Sessions attached to an upcoming booking require cancelling the booking first. Delivered and confirmed lessons are final.
- If no lessons were delivered at all, your refund is the full amount minus third-party payment processing fees.
- Packages inactive for an extended period are automatically refunded for their undelivered sessions.
- Complaints are quality feedback and do not trigger refunds.
- Payment processing, banking, and card-network processes are operated by third parties, and their outcomes and timing are outside the Platform's control.
17. Entire Agreement
These Terms, together with our Privacy Policy and any policies expressly incorporated by reference, constitute the entire agreement between you and DrivingPro in relation to your use of the Platform and supersede all prior understandings, representations, and agreements relating to the Platform.
18. Severability
If any provision of these Terms is found to be invalid, illegal, or unenforceable, the remaining provisions will continue in full force and effect.
19. General
These Terms are governed by the laws of Australia, without prejudice to any rights you have under the laws of your state or territory or the Australian Consumer Law. We may update these Terms from time to time. Material changes will be notified by email to your registered address.
Our collection, use, and disclosure of personal information is governed by our Privacy Policy, which forms part of these Terms.
